VA Publishes Final Regulation to Aid Veterans Exposed
to Agent Orange in Korea
Will Provide Easier Path to Health Care and Benefits
WASHINGTON Veterans exposed to herbicides while
serving along the demilitarized zone (DMZ) in Korea
will have an easier path to access quality health care
and benefits under a Department of Veterans Affairs
(VA) final regulation that will expand the dates when
illnesses caused by herbicide exposure can be presumed
to be related to Agent Orange.
VAs primary mission is to be an advocate for
Veterans, said Secretary of Veterans Affairs Eric K.
Shinseki With this new regulation VA has cleared a
path for more Veterans who served in the demilitarized
zone in Korea to receive access to our quality health
care and disability benefits for exposure to Agent
Orange.
Under the final regulation published today in the
Federal Register, VA will presume herbicide exposure
for any Veteran who served between April 1, 1968, and
Aug. 31, 1971, in a unit determined by VA and the
Department of Defense (DoD) to have operated in an area
in or near the Korean DMZ in which herbicides were
applied.
Previously, VA recognized that Agent Orange exposure
could only be conceded to Veterans who served in
certain units along the Korean DMZ between April 1968
and July 1969.
In practical terms, eligible Veterans who have specific
illnesses VA presumes to be associated with herbicide
exposure do not have to prove an association between
their illness and their military service. This
presumption simplifies and speeds up the application
process for benefits and ensures that Veterans receive
the benefits they deserve.
Click on these links to learn about Veterans' diseases
associated with Agent Orange exposure at
http://www.publichealth.va.gov/exposures/agentorange/diseases.asp
and birth defects in children of Vietnam-era Veterans
at
http://www.publichealth.va.gov/exposures/agentorange/birth_defects.asp.
VA encourages Veterans with covered service in Korea
who have medical conditions that may be related to
Agent Orange to submit their applications for access to
VA health care and compensation as soon as possible so
the agency can begin processing their claims.
Individuals can go to website
http://www.vba.va.gov/bln/21/AO/claimherbicide.htm to
get a more complete understanding of how to file a
claim for presumptive conditions related to herbicide
exposure, as well as what evidence is needed by VA to
make a decision about disability compensation or
survivors benefits.
Additional information about Agent Orange and VAs
services for Veterans exposed to the chemical is
available at www.publichealth.va.gov/exposures/agentorange.
The regulation is available on the Office of the
Federal Register website at http://www.ofr.gov/.

Comments: During spring and summer of 1968, as best I can
recall, myself and others carried Indian Tanks of
herbicide into the secure compound and sprayed weeds.
It was hot, the stuff was allegedly safe, and we
sprayed each other. I recall filling my tank from a
barrel of oily water with an orange stripe around it.
Begining within two years of service, I had a
bunch of fatty growths show up under my skin, most
about the size of the last joint of a finger. Except
the one on my left shoulder where the tank's shoulder
strap had worn through the skin--that one was 2
inches long, fat like a frog, with two roots like
frog legs. No one else in my family ever had any such
growths and no doctor ever said it was anything
special.
Then, when I went for the Agent Orange registry
physical in 2001, the doctor said he'd often seen
such fatty growths on men who had been exposed to AO.
However, since I was not boots on the ground in
Nam, and I did not, and still do not, have any of the
listed ways to die from AO, I was told it didn't
happen.
I eventually ended up service connected for neck
injuries and will probably receive more for PTSD.
Flash forward to February 2012, when I received a
PERSONALIZED Veterans Health Benefits Booklet and
found the following statement under my allged unique
eligibilty factor: Determined to be a Vietnam-era
herbicide-exposed Veteran.
Hmmm. Neither my PTSD counselor nor my Vet
Service Rep has ever seen that designation.

1969 to August 1969. During that time I traveled all
over, from Kaiser to the sea and from the DMZ to Sea
Range. Only because I could show -- with photos and
with information I painstakingly dug up myself -- that
I was probably exposed to AO could I get presumption
(and that on probability, not on unit or anything else).
I have searched, and am still searching, for the
Senator Glenn letter and the response from the Dept of
the Army. I have been in touch with the archivist for
Senator Glenn's papers and he could find nothing.
By the way, the response is supposed to be dated May,
1996 -- the 1999 date you may have heard of comes from
the first VA-released list of possible units exposed.
If I can turn up the letter and/or the response I'll
send it to be posted here and everywhere else I can

Agent Orange during its probe into claims that the
toxic defoliant was buried on Camp Carroll.
Led by Pokyong National University Chief Professor
Doctor Gon Ok and U.S. Forces Korea Engineer Col.

the Chilgok County Office.
The investigation began in May 2011 following a
report on KPHO TV in Phoenix where U.S. veterans
claimed they buried Agent Orange on Camp Carroll in
1978.
Birchmeier said the bilateral investigation found no
evidence that Agent Orange was buried on Camp Carroll
and discovered no risk to public health on the U.S.
Army post.
I want you to know that we have found no definitive
evidence that Agent Orange was buried or stored Camp

After the day surgery and taking one small daily Thyroid pill, I experienced a MEDICAL MIRACLE. No kidding. I was sick, depressed, overweight and in cronic pain FOR YEARS. As a mountain climber and marathon runner, I was reduced to a 250 pound
slug on a scooter. Sometimes I needed help even
getting off the toilet or a chair. The

WILL FEEL LIKE YOU ARE 30 YEARS OLD AGAIN. He was
right! AGENT ORANGE CAUSED ALL THIS!!! My low point
was at 49 years old. Today, less than 18 months after
I met the Endocrinologist, I am now hiking five to
ten miles up steep mountain trails. I walk without
any assistive devises. I lost sixty pounds and kept
it off. THE BEST PART IS THE PRESCRIPTIONS! I quit
taking over ten different Rx's for Depression, Severe
Osteoporosis, Chronic Pain, Diabetes and much more. I
WAS ON 126 MGS OF OXICONTIN PER DAY! Today I use
aspirin and Percocet. BUT The Time Has Come to go off
the Percocet. I am now trailing off that and doing
OK.
IF YOU WERE IN KOREA IN THE LATE 1960s, AND WERE

Comments: I have photos of the my missile unit in and around
Kwang Chon on the norther west coast from 1969 to
1970. No vegetation around us. I now have been
diagnosed with Chronic Lymphocytic Leukemia. VA has
denied my claim, because their records does not show
agent orange use in that area. Bull Crap! It was
used all over Korea in the late 1960's.

those stationed there worked in the DMZ. I worked on

Comments: I served in the DMZ in 1968 but was unaware of the use
of Agent Orange untill 2007 when a friend of mine
called who knew I was there at that time and told me
to look up Agent Orange use in Korea in 1968-69. I
came across a news confrence with a Defense Dept
General in 2000 who said " it is not a conspiracy and
we are not hiding anything it just fell through the
cracks". 32 years of cracks ???? He also said that
the Defense Dept was sending a letter to all the men
stationed at the DMZ in certain units confirming the
use of Agent Orange. It is now 2011 and I have still
not received any letter. The answer is the almighty
dollar. No DMZ veteran received any benefits prior to
2001 which translates into hundreds of millions or
possibly billions of dollars. I put in a claim in 2007
and was given 20% for Diabetes in 2008. I have
multiple diseases secondary to Diabetes but I am being
denied because of long term medical records. Many
veterans are in the same boat as me. Not knowing you
were exposed you did not have anual visits to the
doctors office and thus medical records are scarce.
I have read many blogs relating to benefits and
information on Agent Orange but everyone is missing
the big picture. We served our country honorably when
our country needed us and they knowingly put our
health in harms way and kept it a secret for 32 years.
I wonder how many DMZ vets died of cancer without ever
knowing they were exposed ? I wonder how many DMZ vets
still do not know they were exposed ? The Dmz Vets
need to organize and confront the Government about
this secret coverup.

watched him get one illness after another...My
brother a disabled Viet Nam Vet and my husband had
the same health issues...Heart, Lung, Blood, Skin
Rash...But my husband was never in Viet Nam...
My husband put a claim in 2005, a few days before his
death he heard back from the VA...denied...
John stood there holding that letter, he looked over
where I was standing and said ...In case I don't make
it, you carry on and don't give up...even if we don't
win, maybe it will help another veteran... John
passed away in my arms ... 4 days after that letter...
It will be 6 years coming up and I'm still trying not
to let his death be in vain...The Korean Veterans
need to Unit...I can make a claim and within a month
a letter says were looking at your claim, a few weeks
after that the denial letter... I have a ton of
information, but even when its right on, they turn
you down... Together I hope we will untie like Viet
Nam Veterans did and They were finally heard and
God Bless Each and Everyone...Thank You for your
service... Marie

Comments: My step-father served in Vietnam, but we are unable to
find any paperwork to prove that he was there. However,
we know that he was in the Korean DMZ, setting up camps
and conducting raids across the borders. Sometimes his
missions took place in Laos and Cambodia (no papers on
Laos or Cambodia either). He,too, was transferred to
Germany after being injured in Korea. We are certain he
was exposed to Agent Orange during his time of service
due to the nature of his missions and the heart attacks
and diabetes which took his life at age 54. Service
dates 1966 - 1972. If you have any information, please

Comments: My husband was on the DMZ 68-69, died 8-25-2008. Upon
my husbands death I applied for all the usual stuff
including accrued benefits. After 3 denials, i received
DIC and medical. I want to know why I can receive
retro accrued benefits for IHD that he filed for in
1998,2000,2002. All of which were denid "No boots on
ground in Nam. I filed for accrued retro compensation
under Nehmer in Jan. 2011, denied again "no boots on
ground in Nam."I feel I have been discriminated against
because I should fall under Nehmer protection Like that
of Nam Widows I had no idea AO discriminated due to
boundaries!!
When my husband came home in 1971 He was having severe
nose bleeds, that in turn resulted in very high blood
pressure and high cholesterol. His first heart attack
was in 1985. 1990 diabetes 11,thyroid, 5 by-passes,
1997 received difb/pacemaker. Also most all bypasses
blocked. He was also told he needed heart transplant.
I watched my husband die a slow death. He was never
right after Military got through with him. The Widows
of these Vets need to be compensated also like those of
the Nam Widows. Nehmer, was about the VA making it
next to impossible for AO victims to receive SC. Duh,
isn't this the same thing for Korean Vets and their
Widows? My husband was with the 5/38th 2ond. div.1968-
1969. If anyone has any knowledge of this unit Please
tell me about it. I have searched on line to no avail.
I know he had Kypto clearance, and he had a Indian
patch on his uniform.

Comments: I served my country proudly from 1966 through 1969. I
was with the 1st of 9th 2ID at Middle Camp Custer April
1967 and then north of ImJin (Libby Bridge area) to
Camp Young 1968. We rotated back south to Custer at the
beginning of May 1968.
"The Pueblo Incident was the cause of our Red Alert"
and if 'Joe Jumped' our life expectancy was less than
1/2 hour. We were there just to slow them down.
It was a very 'special' in April of 1968 because we
began to receive Hostile Fire pay, so I received the
$55.00 for April and May 1968. (unlike Nam it WAS taxed)
Also, when I was reassigned to Germany I was directed
to wear the Indian Head on my right shoulder.
Looking for any fellows that may have served in the
area during that time, especially the time period on
the DMZ.
I am certain we all were exposed to AO.
Fell free to contact me.

very important to add your name to this
petition. We need full disclosure of the real dates
of when and where they used Agent Orange in Korea or
anywhere else for that matter.
There are declassified
DOD Documents that state different dates of use and
areas of use other than those admitted to. I have
these documents and would be
more than happy to attach them to an email for anyone
that signs the petition.
We need 5000 signatures by 22 October 2011. We only
